§ 24-303. Possession or consumption of alcoholic liquors in public places.

  • For the purposes of this section, the term "alcoholic liquor" shall be defined as in section 2 of the Michigan Liquor Control Act, and shall include any beverage containing more than one-half of one percent of alcohol by volume, including beer, wine and spirits.

    (1)

    No person shall consume any alcoholic liquor while in or upon public streets, alleys, sidewalks, parking lots, or other public ways.

    (2)

    No person shall be in possession of any glass, can or other open container containing alcoholic liquor on any thoroughfare, street, sidewalk, alley, parking lot or any other public way.

    (3)

    No person licensed to sell alcoholic liquor, or its employees or agents, shall permit any person to remove from such premises, any alcoholic liquor in any open container.

    (4)

    No person shall possess alcoholic liquor upon or within any off-street parking lot or parking garage, except in its original unopened container with the seal unbroken.
